9. Privacy and Data Protection
The Branch is committed to protecting personal information and processing data in accordance with the General Data Protection Regulation (GDPR), the Data Protection Act 2018 (Ireland), and applicable Irish and European data protection laws. The Branch acts as data controller in respect of personal data collected through this website and branch activities.
What personal data we collect
Personal data is information that identifies you or can be used to identify or contact you. Depending on how you interact with us, we may collect your name, postal address, email address, phone number, and information about your participation in branch activities (such as class enrolments or competition entries). We do not collect special category data (such as health information) unless specifically required and with your explicit consent.
Lawful basis and purposes
We process your personal data only where we have a lawful basis to do so under GDPR. The lawful bases we rely on are:
- Consent — where you have opted in to receive communications from us (for example, by submitting an online form or signing up to a mailing list). You may withdraw your consent at any time by contacting us at cceportmearnog@gmail.com.
- Contract — where processing is necessary to fulfil a registration or membership arrangement you have entered into with us.
- Legitimate interests — where processing is necessary for our legitimate interests in administering branch activities, communicating with members, and promoting Irish traditional arts and culture, provided those interests are not overridden by your rights and interests.
- Legal obligation — where we are required to retain or process data to comply with a legal obligation, including safeguarding, financial, insurance, or governance requirements.
How long we keep your data
We retain personal data only for as long as necessary for the purpose for which it was collected, or as required by law:
- Contact and enquiry records are retained for up to 2 years from last contact.
- Membership and class enrolment records are retained for the duration of membership and for up to 3 years thereafter.
- Financial records (including records of fees paid) are retained for 7 years in accordance with Irish tax and accounting requirements.
- Safeguarding records are retained in accordance with the requirements of Comhaltas Ceoltóirí Éireann's child protection and safeguarding policies.
Who we share your data with
We do not sell or rent personal data. We may share data in the following limited circumstances:
- Comhaltas Ceoltóirí Éireann — as our affiliated national organisation, certain membership and competition registration data may be shared with Comhaltas Ceoltóirí Éireann for the purposes of administering national membership and competitions.
- Google (reCAPTCHA Enterprise) — we use Google reCAPTCHA Enterprise to protect our website and forms from automated abuse. Google operates as a data processor on our behalf and processes data subject to its own Privacy Policy and data processing terms. As Google is a US-based provider, this involves a transfer of data outside the European Economic Area; such transfers are made under appropriate safeguards including Standard Contractual Clauses.
- Legal requirements — we may disclose data where required to do so by law or by a competent authority.
Cookies and local storage
This website keeps your sign-in session in your browser's local storage so that you stay signed in between visits, and stores a small flag locally to remember that you have dismissed the cookie notice. We use Google reCAPTCHA Enterprise to protect accounts and forms from automated abuse; reCAPTCHA is provided by Google, sets a cookie, and is subject to Google's Privacy Policy. We do not use any analytics, tracking, or advertising cookies.
Children's data
The Branch runs classes and activities for children and young people. Where we collect personal data relating to members under the age of 16, we require the consent of a parent or guardian. We handle children's data with particular care and in accordance with our safeguarding and child protection policies and the requirements of Comhaltas Ceoltóirí Éireann.
10. Your Data Protection Rights
Under GDPR and the Data Protection Act 2018, you have the following rights in relation to your personal data:
- Right of access — you may request a copy of the personal data we hold about you.
- Right to rectification — you may request that we correct inaccurate or incomplete personal data.
- Right to erasure — you may request that we delete your personal data where there is no longer a lawful basis for us to hold it.
- Right to data portability — you may request that we provide your personal data in a structured, commonly used, machine-readable format.
- Right to restrict processing — you may ask us to restrict the processing of your personal data in certain circumstances.
- Right to object — you may object to processing based on our legitimate interests. We will cease processing unless we can demonstrate compelling legitimate grounds that override your interests.
- Right to withdraw consent — where processing is based on your consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
To exercise any of these rights, contact us at cceportmearnog@gmail.com with the subject line Data Subject Request. We may require proof of identity before processing the request. We will respond within one month of receipt of a valid request; for complex or numerous requests we may extend this by a further two months and will notify you accordingly.
Certain records may need to be retained where required for legal, safeguarding, financial, insurance, governance, or historical record-keeping purposes, even where a deletion request is made.
If you are not satisfied with how we handle your personal data, you have the right to lodge a complaint with the Data Protection Commission, Ireland's supervisory authority, at dataprotection.ie.
